Who is responsible for processing your personal data?

VICTÒRIA MARTÍ BERNADÓ is the DATA CONTROLLER responsible for processing the USER’S personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data?

To maintain a commercial relationship with the user. The intended processing operations include:
  • Sending commercial and advertising communications by email, fax, SMS, MMS, social media or any other current or future electronic or physical means. These communications will be managed by the DATA CONTROLLER and will relate to its products, services or collaborators. Third parties will not have access to the data.
  • Conducting market research and statistical analysis.
  • Processing orders, requests or any type of enquiry submitted by the USER through the contact methods available on the DATA CONTROLLER’S website.
  • Sending newsletters about news, offers and promotions.

What is the legal basis for processing your data?

The processing is based on Article 6 of the GDPR:
  • With the USER’S consent: sending commercial communications and newsletters.
  • For the legitimate interest of the DATA CONTROLLER: market research, analysis and processing of requests.

How long will we keep your data?

Your data will be retained for as long as necessary to fulfil the purpose of the processing or for the legally established retention periods. Once no longer required, the data will be securely deleted.

Who do we share your data with?

No data will be disclosed to third parties except where required by law or when necessary to provide communication-related services under confidentiality and data processing agreements in accordance with applicable legislation.

What are your rights?

  • The right to withdraw your consent at any time.
  • The right of access, rectification, portability and erasure of your data, as well as the right to restrict or object to its processing.
  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with the applicable legislation.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the relevant boxes and entering data in the fields marked with an asterisk (*) on the contact form or download forms, USERS expressly, freely and unequivocally agree that their data are necessary for the provider to process their request, while providing data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the DATA CONTROLLER are accurate and undertakes to notify any changes. The DATA CONTROLLER informs USERS that all data requested through the website are mandatory, as they are necessary to provide an optimal service. If all the required data are not provided, it cannot be guaranteed that the information and services offered will fully meet the USER’S needs.

3. SECURITY MEASURES

In accordance with current data protection legislation, the DATA CONTROLLER complies with all the provisions of the GDPR and the LOPDGDD regarding the processing of personal data under its responsibility, and with the principles described in Article 5 of the GDPR, ensuring that data are processed lawfully, fairly and transparently in relation to the data subject, and that they are adequate, relevant and limited to what is necessary. The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures required by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with the necessary information to exercise those rights. 4. SOCIAL MEDIA PRIVACY POLICY

Who is responsible for processing your personal data?

VICTÒRIA MARTÍ BERNADÓ, hereinafter the DATA CONTROLLER, informs the USER that it has created profiles on the social media platforms Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo and Google+, and is responsible for processing users’ personal data on those platforms. These data will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), providing the following information:

Purpose of the processing: to maintain a relationship between the USER and the DATA CONTROLLER, which may include:
  • Processing requests and enquiries submitted to the DATA CONTROLLER.
  • Providing information about activities and events organised by the DATA CONTROLLER.
  • Providing information about products or services offered by the DATA CONTROLLER.
  • Interacting through the official social media profiles.

What is the legal basis for processing your data?

Legal basis: Article 6.1(a) of the GDPR. The data subject has given consent to the processing of their personal data for one or more specific purposes. By following our social media profiles, the USER expressly consents to the processing of their data in accordance with this policy. The USER may consult the privacy policies of the respective social media platforms at any time and configure their profile to ensure their privacy. The DATA CONTROLLER has access to and processes the USER’S public information, especially their contact name, and uses it solely within the relevant social media platform. It will only be incorporated into a DATA CONTROLLER file if necessary to manage the USER’S request.

How long do we keep your data?

Retention period: until the USER withdraws the consent previously granted.

Who do we share your data with?

Data disclosure: information provided by the USER through the DATA CONTROLLER’S social media profiles may be visible to other users depending on the USER’S own privacy settings. No other disclosure is envisaged except where required by law or necessary for the operation of the service.

Use of the profile

The DATA CONTROLLER may carry out the following actions:
  • Access public profile information.
  • Publish on the USER’S profile information already published on the DATA CONTROLLER’S social media profile.
  • Send personal and individual messages through the social media platform.
  • Publish updates on the page that will appear on the USER’S profile.
The USER may manage their connections, delete content and restrict who they share information with by accessing their privacy settings.

Posts

Once the USER becomes a follower of or joins the DATA CONTROLLER’S social media profile, they may post comments, links, images or other multimedia content. The USER shall be solely responsible for ensuring that such content is their own property, that they hold the necessary copyright or that they have obtained the appropriate third-party authorisation. Any publication that infringes morality, public order, intellectual property rights or applicable legislation is strictly prohibited. In such cases, the DATA CONTROLLER may immediately remove the content and request the permanent blocking of the USER. The DATA CONTROLLER is not responsible for content freely published by USERS. Posts may be viewed by other users of the social media platform. Images published will not be stored by the DATA CONTROLLER but will remain on the relevant social media platform.

Data relating to minors or persons with special capacity needs

Persons under 14 years of age are not permitted to access or register on the DATA CONTROLLER’S social media profiles. In the case of persons with special capacity needs, the consent of the holder of parental authority or their legal guardian will be required. The DATA CONTROLLER shall not be held liable for the use of social media by minors or persons with special capacity needs without the appropriate authorisation.
